TERMS AND CONDITIONS
This training platform (the ‘Platform’) is provided by PATEK PHILIPPE SA GENÈVE (‘Patek Philippe’) and is dedicated to, and exclusively reserved for, training staff tasked with selling Patek Philippe products at points of sale in its international authorized-retailer network.
By accessing, browsing or otherwise using this Platform you agree to these Privacy and Terms of use (the “Terms and Conditions”). Your continued use of the Platform following any changes to the Terms and Conditions indicates that you accept any changes.

All rights not expressly granted in these Terms and Conditions are expressly reserved by Patek Philippe.
1. Ownership and Use of the Platform
Copyright© Patek Philippe. The copyright and all other intellectual property rights on the Platform and all content displayed on or accessible from the Platform (“Content”) is owned by or licensed to Patek Philippe and protected by the Swiss copyright laws, international copyright treaties and all other applicable copyright and intellectual property laws.
You are granted a limited, personal, non-exclusive, non-transferable, revocable license to access, browse and use the Platform and the Content only for your own personal training that Patek Philippe may revoke at any time in our sole discretion.
Therefore, you undertake not to breach this limited right of use, and in particular not to supply third parties with your login, which is personal and strictly confidential, and not to reproduce, download, modify, distribute, alter, republish, supply to third parties, disclose or disseminate in any way whatsoever any part of the Platform or Content subject to your civil and criminal liability being incurred.
2. Liability
Patek Philippe has taken the greatest care in designing and producing the Platform and Content and tries to ensure a training tool of the highest possible quality. However, Patek Philippe cannot be held liable for neither direct or indirect damage suffered, nor errors, omissions or use of the Content.
3. Exclusion of Warranties
To the fullest extent permitted by applicable law, Patek Philippe excludes all warranties, representations or understandings whatsoever (whether express or implied) in relation to the Platform and the Content, specifically including but not limited to, any warranty or representation that the Platform and the Content are free from computer viruses, errors and omissions and do not infringe any third parties’ rights.
4. Trademarks
Patek Philippe owns the rights in and to the www.patektrainingplatform.com domain name. Other trademarks, products, services and company names mentioned on the Platform or in Content may be trademarks of their respective owners or licensors and the rights in such marks are reserved to their respective owners or licensors.
5. Links
By virtue of hypertext or other computer links, you may be able to access other website pages on the Internet which are not part of Patek Philippe's Platform content. Patek Philippe is not responsible for nor assumes any liability for the contents of other sites which are linked to Patek Philippe's Platform. The provision by Patek Philippe of a link to another site does not constitute authorization by Patek Philippe to you to access materials held at that location, nor is it evidence of any endorsement by Patek Philippe of the material held there. You acknowledge and agree that you access such third party sites, services, products or content at your own risk and are wholly responsible for making your own independent judgment regarding your use or interaction with the same. Patek Philippe recommends you read the privacy and terms of use policies of each third party’s site that you access.
The Platform must not be framed on any other site. Patek Philippe reserves the right to withdraw linking permission without notice.
6. Further Assurances
You agree that you will do any and all acts and things, and execute any and all documents, that Patek Philippe may reasonably request in order to carry out the intended provisions of these Terms and Conditions.
7. Technical requirements
The Platform and its content is intended to operate optimally with the following minimum configuration:
- Computers:
o Chrome: latest stable release
o Firefox: latest stable release
o Microsoft edge: latest stable release
o Safari 10
o Internet Explorer 11
o Minimum 10Mbits ADSL connection for smooth use of the platform
· Mobile devices such as iPad or Android tablets:
o iOS Safari 9
o Android browser: latest stable release
o Chrome for Android: latest stable release
o Minimum 4G 10Mbits connection for smooth use of the platform
8. Cookies
Two cookies are used by this Platform. The essential one is the session cookie, usually called “TotaraSession”. You must allow this cookie into your browser to provide continuity and maintain your login from page to page. When you log out or close the browser this cookie is destroyed (in your browser and on the server).
The other cookie is purely for convenience, usually called “Totaraid”. It just remembers your username within the browser. This means when you return to this Platform the username field on the login page will be already filled out for you. It is safe to refuse this cookie - you will just have to retype your username every time you log in.
9. Use of data and Privacy
Patek Philippe is responsible for collecting, using, and otherwise processing some of your personal data (the “Personal Data”). The purpose of this article is to let you know which personal data Patek Philippe collects about you (the “Data Subject”), the reasons why Patek Philippe uses such personal data, how long Patek Philippe keeps them, what your rights are and how you can exercise them.
Personal Data include any information relating to an identified (e.g., surname, first name) or identifiable (e.g., alias, nationality, address) natural person.
a) Data processed
Patek Philippe processes data to the extent necessary in the context of the Platform (e.g. tests scores, assessments), in particular identification information (e.g., name, first name(s), physical or email address), professional information (e.g., professional address or email, location, retailer’s name, job position), personal information (e.g., date of birth) and technical information (e.g., IP addresses).
In addition, Patek Philippe may collect data that you communicate to Patek Philippe (e.g., by email or any other means of communication).
b) Purposes
Patek Philippe generally processes and collects your Personal Data, including without limitation for the purposes of (collectively the "Purposes"):
· allowing Data Subjects to track his progress on the Platform and in general;
· granting Data Subjects tags certifying his level;
· allowing Retailers to track the progress of their employees;
· allowing Training Managers of each markets to follow the progress of sales advisers;
· establishing statistics;
· sending invitation to Data Subjects to attend seminars;
· monitoring the attendance of the Platform;
· sending newsletters to Data Subjects.
Patek Philippe does not use Personal Data for profiling or automated individual decision-making purposes.
c) Rights
At all times and subjects to applicable regulations, you have the right to:
· access and obtain a copy of your Personal Data;
· rectify or request the erasure of your Personal Data when they are inaccurate or incomplete;
· request the erasure of your Personal Data when they are no longer necessary for the purposes for which they were collected or processed or when you withdraw the consent necessary for the Processing;
· object on legitimate grounds to the Processing of your Personal Data;
· request the limitation of the Processing of your Personal Data;
· lodge a complaint with supervisory authorities regarding the Processing of your Personal Data.
d) Processing and Retention
Patek Philippe may conduct its Processing either directly or indirectly, through other parties, which process Personal Data on behalf of Patek Philippe (the "Processors"). However, Patek Philippe does not sell your Personal Data to any third party.
In principle, your Personal Data are retained for as long as necessary for Patek Philippe to fulfill the Purposes or until you withdraw your consent, provided that Patek Philippe is not legally required or permitted to continue to hold such Personal Data (e.g., to establish, exercise and/or defend legal claims, investigations or similar proceedings).
9. Applicable law
The Terms and Conditions are subject to Swiss law. When it is written in several languages, only the French version has authority in law.
The amicable or possibly contentious settlement of any dispute between you and Patek Philippe will be subject to the dispute-resolution clause in the agreement binding between Patek Philippe and the Patek Philippe authorized point of sale in which you work.
